Fingerscan Digital Inc. (“Fingerscan Digital,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have. It applies to our website at bayarealivescanandmore.com (the “Site”) and to the in-person services we provide at our San Jose office, including Live Scan fingerprinting, FBI background checks, fingerprint cards, apostille and authentication services, notary services, ITIN application assistance, tax preparation, and document translation.

Because of the nature of our services, we handle information that California law treats as maramdamin — including your fingerprints (biometric information), Social Security or ITIN numbers, government identification, and immigration or citizenship status. We take that responsibility seriously, and this policy describes how we protect it.

When you request our services, schedule an appointment, fill out a form, or visit our office, you may provide:

  • Contact and identity details — your name, date of birth, mailing address, email address, and phone number.
  • Government identifiers — driver’s license, passport, or other identification you present to verify your identity.
  • Sensitive identifiers — your Social Security number or ITIN, and citizenship or immigration status, when the service you request requires them (for example, ITIN applications, tax preparation, or immigration fingerprinting).
  • Fingerprints and biometric information — captured electronically through Live Scan or on an FD-258 ink fingerprint card.
  • Documents you bring to us — such as birth, marriage, or death certificates, diplomas, powers of attorney, FBI reports, or other records you ask us to fingerprint, notarize, apostille, authenticate, or translate.
  • Payment information — processed through a third-party payment processor (we do not store full card numbers).
  • Communications — the content of emails, calls, and messages you send us.

Information we collect automatically on the Site

  • Device and usage data — IP address, browser type, pages viewed, referring page, and the dates and times of your visit.
  • Cookies and similar technologies — used to operate the Site, remember preferences, and understand how the Site is used (see Section 6).
  • Call tracking — when you call a tracked number, our call-tracking provider (CallRail) may record the calling number, call time, and duration to help us understand which services customers ask about.
  • Translation — if you use the on-site translation tool (GTranslate), your selected language and related technical data are processed to display translated content.

Information from other sources

We may receive limited information from government agencies or channeler partners involved in completing your request, from a person who refers you to us, or from your authorized representative (such as an attorney or family member acting on your behalf).

2. Categories of personal information

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), the categories of personal information we may collect, the reasons we collect them, and the types of recipients we may disclose them to are summarized below.

We collect this information directly from you, automatically through the Site, and occasionally from the agencies, partners, or representatives involved in your request. We may disclose these categories to government agencies, service providers, and others as described in Section 5.

3. Sensitive personal information

We use sensitive information only to provide your service

The CCPA/CPRA treats certain data as “sensitive personal information,” including your Social Security number or ITIN, biometric information used to identify you (your fingerprints), and your citizenship or immigration status. We collect this information only when the service you request requires it, and we use it solely to deliver that service and meet related legal and recordkeeping obligations.

Fingerprints and biometric information

When we capture your fingerprints through Live Scan, they are transmitted electronically to the appropriate agency — such as the California Department of Justice and, through an FBI-approved channeler partner, the Federal Bureau of Investigation — to process the background check or service you requested. When we prepare an FD-258 ink fingerprint card, the physical card is provided to you or submitted on your behalf as your request requires. We do not sell, lease, trade, or otherwise profit from your biometric information, and we do not retain your fingerprints beyond what is necessary to complete your transaction and meet applicable legal requirements.

  • To operate, secure, maintain, and improve the Site.
  • To comply with our legal, regulatory, and recordkeeping obligations and to respond to lawful requests.
  • To respond to your questions, reviews, and customer-service needs.

We share personal information only as needed to provide our services and operate our business. We do hindi sell your personal information, and we do hindi share it for cross-context behavioral advertising.

  • Government agencies. To complete your request, we transmit required information to agencies such as the California Department of Justice, the FBI (through an FBI-approved channeler partner), the IRS, the California Secretary of State, and the U.S. Department of State.

6. Cookies and tracking technologies

You can control or delete cookies through your browser settings; however, some features of the Site may not work as intended if cookies are disabled. Call-tracking technology may record metadata about calls you place to our tracked numbers, as described in Section 1.

7. How long we keep your information

We keep personal information only as long as necessary to provide the service you requested, to satisfy legal, tax, and recordkeeping obligations, to resolve disputes, and to enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it. As described above, we do not retain your fingerprints beyond what is necessary to complete your transaction and meet applicable legal requirements.

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, however, so we cannot guarantee absolute security. If you believe your interaction with us is no longer secure, please contact us right away using the details in Section 13.

9. Your California privacy rights

If you are a California resident, the CCPA/CPRA gives you the following rights, subject to certain exceptions:

  • Right to know and access. Request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
  • Right to delete. Request that we delete personal information we collected from you.
  • Right to correct. Request that we correct inaccurate personal information about you.
  • Right to opt out of sale or sharing. We do not sell or share personal information for cross-context behavioral advertising, so there is nothing to opt out of; we honor this right regardless.
  • Right to limit the use of sensitive personal information. We use sensitive personal information only to provide the services you request and for purposes the law permits without a separate right to limit.
  • Right to non-discrimination. We will not discriminate against you for exercising any of these rights.

How to submit a request. You may exercise these rights by calling us at (408) 766-3528 or emailing info@fingerscan-digital.com. To protect your information, we will take reasonable steps to verify your identity before responding, which may require you to confirm details we already have on file. You may use an authorized agent to submit a request on your behalf; we may ask the agent for proof of authorization and may still ask you to verify your identity.

California “Shine the Light.” California Civil Code Section 1798.83 lets California residents request information about disclosures of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their own direct marketing.

10. Children’s privacy

The Site is intended for adults and is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. When we provide in-person services involving a minor (for example, fingerprinting), we do so with the involvement and consent of the minor’s parent or legal guardian. If you believe a child has provided us personal information online, please contact us so we can remove it.
