About These Terms
These Terms of Service govern your use of this website and the services provided by Fingerscan Digital Inc. By booking an appointment, submitting documents, or using any service described here, you agree to these terms. Please read them before your visit.
Who We Are
Fingerscan Digital Inc. is a California corporation operating a walk-in and appointment-based document services office at 434 Blossom Hill Road, San Jose, CA 95123. We are a California Department of Justice certified Live Scan provider and an IRS Certifying Acceptance Agent. Our office hours are Monday through Friday, 9:00 AM to 6:00 PM, with Saturday availability by appointment only. You can reach us at (408) 766-3528 or info@fingerscan-digital.com.
For federal FBI Identity History Summary requests, we work with an FBI-approved channeler. Fingerscan Digital Inc. is not itself an FBI-approved channeler, and we do not represent ourselves as one.
What We Are Not
This section is important, and we want it stated plainly.
We are not an attorney or a law firm. We cannot give legal advice, recommend a course of legal action, explain which form you should file, or tell you what your documents mean for your legal situation. Nothing on this website and nothing said by our staff constitutes legal advice or creates an attorney-client relationship. If you need legal advice, please consult a licensed attorney.
We are not a government agency. We are a private business. We are not affiliated with, endorsed by, or acting on behalf of the Federal Bureau of Investigation, the U.S. Department of State, the California Department of Justice, the California Secretary of State, U.S. Citizenship and Immigration Services, or the Internal Revenue Service. Where we hold a certification or designation from an agency, we identify it specifically.
We are not a tax advisor or financial advisor except within the defined scope of the tax preparation and IRS Certifying Acceptance Agent services we expressly agree to provide.
Services We Provide
Depending on your needs, we may provide Live Scan fingerprinting, FD-258 ink fingerprint cards, FBI Identity History Summary requests through our channeler partner, document apostille and authentication coordination, notary public services, ITIN application and renewal assistance as an IRS Certifying Acceptance Agent, immigration-related fingerprinting, passport photographs, mobile and group fingerprinting, tax preparation, and document translation. Not every service is available at every visit, and some require an appointment.
Government Fees and Service Fees
Many of our services involve fees set by government agencies rather than by us. For fingerprinting, applicable California Department of Justice and FBI fees are collected at your office visit and remitted to those agencies on your behalf. Apostille and authentication services involve fees charged by the California Secretary of State or the U.S. Department of State. These government fees are set by the agencies, are subject to change without notice to us, and are separate from our service fee.
Our service fee covers our work: preparing your submission, capturing fingerprints, reviewing documents for completeness, courier or mail handling where applicable, and communicating with you about status. Once we have submitted your documents or transmitted your fingerprints to an agency, that work has been performed and the associated government fees have been paid out and are not recoverable by us.
Processing Times Are Estimates, Not Guarantees
Any timeframe we quote is an estimate based on our recent experience. We do not control how quickly the FBI, the U.S. Department of State, the California Secretary of State, the California Department of Justice, the IRS, or any consulate processes a submission. Agency backlogs, federal holidays, government shutdowns, mail and courier delays, and errors or rejections originating with the agency can extend any timeline. We will tell you promptly if we learn your submission has been delayed or rejected, but we cannot guarantee a delivery date and a missed estimate is not a basis for a refund of government fees.
No Guarantee of Outcome
We cannot guarantee that a foreign government, consulate, employer, licensing board, court, or agency will accept a document we have helped you obtain or authenticate. Acceptance is decided by the receiving party, and requirements vary by country and by institution and change without notice. Similarly, we cannot guarantee that the IRS will issue or renew an ITIN, that an agency will return a background check result within any period, or that a fingerprint capture will be accepted on the first attempt.
Where we act as your IRS Certifying Acceptance Agent, our responsibility is limited to correctly preparing and certifying the documentation within the scope of that designation. It does not extend to the IRS decision itself.
Your Responsibilities
You are responsible for confirming what the receiving party actually requires before you order a service. This matters most with apostille and authentication work, where the destination country, the specific document, and whether a translation is required all change what must be done. If you tell us to proceed on incorrect requirements, the work will have been performed and the government fees paid.
You are also responsible for the accuracy and authenticity of every document and every piece of information you give us. Names, dates of birth, and spellings must match your identification exactly. Submitting a forged, altered, or fraudulently obtained document to us is grounds for immediate refusal of service and may be reported to the appropriate authorities.
Identification
Fingerprinting, notarization, and ITIN certification each require valid, unexpired, government-issued photo identification presented in person. We cannot complete these services from a photocopy, a photograph, or an expired document, and we cannot make exceptions. If your identification does not satisfy the applicable requirement, we will not be able to proceed.
Appointments and Walk-Ins
We accept walk-ins during posted business hours and appointments booked in advance. Appointments are held for a reasonable grace period. Saturday service is by appointment only. Mobile and group fingerprinting is arranged by appointment throughout Santa Clara County. Please contact us as early as you can if you need to reschedule so that we can offer the slot to someone else.
Your Documents and Your Information
We handle original documents with care, but we are not an insurer of them. Where a service requires that an original be mailed to a government agency, that document leaves our custody and is subject to the agency’s and the carrier’s handling. We recommend that you retain certified copies of anything irreplaceable before submitting it.
Fingerprint and background check information is transmitted directly to the requesting agency or channeler. We do not receive, store, or have access to your criminal history results, and we cannot tell you what a background check contains or interpret it for you. Our handling of your personal information is described in our Privacy Policy.
Notary Services
Our notary services are performed by a commissioned and bonded California notary public. A notary verifies the identity of the signer and witnesses the signature. A notary does not draft, review, explain, or vouch for the contents of a document, and cannot advise you on which certificate or which document you need. A notarization may be refused where the signer’s identity cannot be established, where the signer does not appear willing or aware, or where the document is incomplete.

Limitation of Liability
To the fullest extent permitted by California law, Fingerscan Digital Inc. is not liable for indirect, incidental, special, or consequential damages arising from our services or from your use of this website, including missed deadlines, denied applications, lost travel or employment opportunities, or delays caused by a government agency or carrier. Nothing in this section limits any liability that cannot lawfully be limited.
Governing Law
These terms are governed by the laws of the State of California. Any dispute arising from them or from our services shall be brought in the state or federal courts located in Santa Clara County, California, and you and we consent to the jurisdiction of those courts.
Changes to These Terms
We may update these terms as our services, or the requirements that govern them, change. The version posted on this page at the time you use a service is the version that applies. The effective date below tells you when this page was last revised.
